Digital Millennium Copyright Act Compliance

1. Copyright Policy

GameBuster respects the intellectual property rights of others and expects our users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA") and other applicable laws.

2. Reporting Copyright Infringement

If you believe that content on GameBuster infringes your copyright, please send a written notice to our designated Copyright Agent with the following information:

Required Information:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of where the material that you claim is infringing is located on the Platform, with enough detail that we can find it (e.g., game URL, screenshot).
  3. Contact information: Your name, address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Signature: Your physical or electronic signature.

3. How to Submit a DMCA Notice

Send your DMCA notice to our designated Copyright Agent:

Note: DMCA notices should only be sent to the email address above. Other inquiries will not receive a response.

4. Counter-Notification

If you believe that content you posted was removed in error or misidentification, you may send a counter-notification to our Copyright Agent with the following information:

  1. Your name, address, telephone number, and email address
  2. Identification of the material that was removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, for any judicial district in which GameBuster may be found
  5. A statement that you will accept service of process from the person who provided the original DMCA notice or their agent
  6. Your physical or electronic signature

5. Our Response Process

5.1 Upon Receiving a Valid DMCA Notice:

  • We will promptly investigate the claim
  • Remove or disable access to the allegedly infringing content
  • Notify the user who posted the content
  • Document the complaint for our records

5.2 Upon Receiving a Valid Counter-Notification:

  • We will forward the counter-notification to the original complainant
  • If the complainant does not file a court action within 10-14 business days, we may restore the removed content

6. Repeat Infringer Policy

GameBuster has a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We may also, at our sole discretion, limit access to the Platform and/or terminate the accounts of any users who infringe intellectual property rights, whether or not there is any repeat infringement.

7. False Claims

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. We may seek damages from any party that submits a notification or counter-notification in bad faith.

8. Developer Responsibilities

As a game developer on GameBuster, you are responsible for ensuring that:

  • You own or have rights to all content in your games
  • Your games do not infringe on third-party copyrights
  • You have proper licenses for any third-party assets used
  • You respond promptly to any copyright concerns

9. Trademark Policy

While this policy primarily addresses copyright, we also respect trademark rights. If you believe content on GameBuster infringes your trademark, please contact us at legal@game-buster.com with details of your claim.
